Looking back in time to almost a year ago, one lone judge changed the face of American morality. I am speaking about now retired federal judge Vaughn R. Walker, who decided to take it upon himself to declare that homosexual had the right to get married. And in doing so, he disregarded the clear voice of the people of California – Prop 8 Let’s take a look @ the oath to become a federal judge:
In the United States, federal judges are required to take not just one, but two oaths. The first oath is this:[36]
I, XXX XXX, do solemnly swear (or affirm) that I will administer justice without respect to persons, and do equal right to the poor and to the rich, and that I will faithfully and impartially discharge and perform all the duties incumbent upon me as XXX under the Constitution and laws of the United States. So help me God.
The second oath that federal judges must take is this; it is the same oath that members of Congress take:[35]
I, AB, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter. So help me God.
Federal statute specifically says that the latter oath “does not affect other oaths required by law.”
In the first oath you will notice the phrase: “I will faithfully and impartially discharge and perform all the duties incumbent upon me”.
There is something that we miss, well really it wasn’t widely reported. The judge, Vaughn R. Walker is gay.
Judge being gay a nonissue during Prop. 8 trial
The biggest open secret in the landmark trial over same-sex marriage being heard in San Francisco is that the federal judge who will decide the case, Chief U.S. District Judge Vaughn Walker, is himself gay.
Many gay politicians in San Francisco and lawyers who have had dealings with Walker say the 65-year-old jurist, appointed to the bench by President George H.W. Bush in 1989, has never taken pains to disguise – or advertise – his orientation.

Gay judge never considered dropping Prop 8 case

(Reuters) – The U.S. judge who struck down California’s gay marriage ban never considered his own homosexuality as a reason to recuse himself from the case, he said on Wednesday.
Former U.S. District Judge Vaughn Walker, who retired from the bench at the end of February, said it would not be appropriate for any judge’s sexual orientation, ethnicity, national origin or gender to stop them from presiding over a case.
“That’s a very slippery slope,” Walker said.
The talk to a handful of reporters was Walker’s first public comments to reporters about presiding over the lawsuit challenging to Proposition 8, which banned gay marriage in California. Walker struck down the ban as unconstitutional, and the case is currently on appeal.
It was also the first time Walker publicly acknowledged his own sexual orientation. Walker said he has been in a relationship with the man for 10 years. “He is a physician,” Walker said.
Walker is a Midwesterner, born in 1944 in Watseka, Illinois, about 90 miles (145 km) south of Chicago. He worked for years at one of San Francisco’s top law firms before being nominated to the federal bench in 1989 by George H.W. Bush.

It seems that he was not impartial, but had a vested interest in the case. Are we or should we be surprised?
